Lawyers

Lawyers are trained in mediation and the collaborative process. Family lawyers provide legal advice. Each client retains a family lawyer to advise them individually. The client consults privately with their respective lawyer and then participates in four way meetings with the other spouse and their lawyer. The lawyers use their non-adversarial mediation skills to assist the clients in reaching a settlement. Lawyers prepare the necessary legal documents to complete the process.

Richard Bennett Peel Halton Collaborative Law Lawyer

Richard T. Bennett has practiced family law in Mississauga for 30 years. He received training in Collaborative Family Law 10 years ago. From the outset, Richard was concerned that adversarial actions between spouses, often exacerbated by counsel, were not only costly financially and emotionally to them but damaging to their children. For that reason, his philosophy has always been geared toward settlement. Richard is a trained mediator, having taken intensive training in mediation and arbitration. In 2011, he completed his Master of Laws in Alternative Dispute Resolution with a focus on not only settling disputes, but assisting in the transformation of parties to avoid and better deal with future conflict. Inspired by the Chief Justice's initiative to expand mediation within the court system, Richard has recently written a major research paper on judicial mediation in family law cases.

I am an experienced litigator (called to the Bar in 1981) who believes that the Collaborative process is the best way to resolve family disputes. It offers the potential for parties to craft their own unique agreement in a safe and respectful environment. In addition to my B.A. and LL.B. I have an LL.M. in ADR (Alternative Dispute Resolution) and I trained in Negotiation at Harvard Law School and in Mediation at York University. I served nine years as a Director, and two terms as President, of the Peel Law Association and have been a member of the Peel Halton Collaborative Group since 2005. I volunteer as a Dispute Resolution Officer in Brampton and sit as a Deputy Judge of the Small Claims Court, an activity that has honed my dispute resolution skills and convinced me that a negotiated settlement is preferable to one imposed by the Court. I am committed to helping families find a humane and meaningful resolution of their problems.

As a litigator at all levels of Ontario courts, I witnessed the negative effects of the adversarial system on families. Parents were pitted against each other, with the children often expected to take sides. A collaborative approach is constructive, and considers the needs of everyone in the family unit. I can help you achieve your personal objectives and also build a working relationship with your spouse to help you both co-parent your children in the future.

I expanded my family law practice to include collaborative law, mediation, and arbitration because of my concern with how the traditional court process tears families apart. These alternatives can lead to effective resolution of family disputes in a manner that helps preserve the dignity of the parties and focus on underlying interests, keeping the children’s interests in the forefront.
I graduated from Queen's University with a Bachelor of Commerce in 1991, and from the Bachelor of Laws program at the University of Western Ontario in 1994. I was called to the Ontario Bar in 1996. I am actively involved in the Oakville community.
